Notice of Proposed Rule Change: Chapter 4-A, Procedural Rule, Equal Educational Opportunity

ADMINISTRATIVE LETTER: 83
POLICY CODE:   AC

The Maine Department of Education and the Maine Human Rights Commission are proposing amendments to Regulation Chapter 4-A, Procedural Rule, Equal Educational Opportunity, which is a joint rule of the Maine Department of Education and the Maine Human Rights Commission.

Chapter 4-A governs the procedure to be followed in processing claims of unlawful educational discrimination filed with the Commission.

The proposed changes to Chapter 4-A are made jointly with the Maine Human Rights Commission, pursuant to 5 M.R.S.A. § 4603.  The proposed amendment to Chapter 4-A changes the term “Compliance Officer” to “Compliance Manager,” which is necessitated by a staffing change at the Maine Human Rights Commission; provides for the adoption of a third-party neutral mediation program; and adds “public charter schools” to the definition of “public school.”

The current rule and the proposed amended rule are available online at  http://www.maine.gov/education/rulechanges.htm.

Hard copies may be obtained by contacting John Gause at the Maine Human Rights Commission at 207-624-6290 or email at John.P.Gause@maine.gov.

A public hearing will be held on Monday, June 25, 2012, 1:00 p.m. at the Maine Human Rights Commission 1st Floor Conference Room, 19 Union Street, Augusta, ME  04330.
