As a recipient of Individuals with Disabilities Education Act (IDEA) funds, the State of Maine is required to identify in writing for local educational agencies any special education rule that is a State-imposed requirement and not mandated under federal IDEA requirements. Maine’s yearly application for IDEA, Part B, funding also requires this identification.
Maine has one provision in its State regulations that exceeds the federal Part B requirements. You can find this provision in Regulation Chapter 101, Section VIII, Eligibility for Free Appropriate Public Education for Five Year Olds by Individualized Education Program Team Determination. This provision allows children who have been served by Child Development Services (CDS) and have a birth date between July 1 and Oct. 15 to stay in the CDS system for another year.
A related feature of this regulation is the distinction in the fonts used to separate federal requirements (non-italicized text) from the State requirements (italicized text) that have been developed in order for the State to implement the federal requirements.
