Notice of proposed rule changes to Chapter 101: special education

The Maine Department of Education is proposing a refinement to two sections of Rule Chapter 101: Maine Unified Special Education Regulation Birth to Age Twenty.

The proposed rule changes involve two refinements:

  • Corrects an error in the current rule regarding consultation services to clarify that it can be a special education service and not only a related service.
  • Changes the requirement to identify a child as having a specific learning disability including removal of the requirement that there be direct evidence of a psychological processing disorder in the form of a specified score on an assessment of psychological processing.

Full proposed language can be found here. A public hearing is scheduled for September 8 from 9 a.m. – 11 a.m. in room 537 of the Cross State Office Building in Augusta.

The deadline for comments is October 14. Comments may be sent to the Department’s Director of Special Services Janice Breton at janice.breton@maine.gov.
