PRIORITY NOTICE: Urgent message regarding uploading student enrollment data

The Maine Department of Education is working quickly to resolve reported issues that School Administrative Units (SAU) are experiencing in uploading and validating October 1 student enrollment counts in the Synergy State Edition Student System. The Department understands your frustration and concern, and we apologize for any inconvenience these issues have caused. Please be advised that Department staff members are on hand to work with SAUs to ensure the data is as accurate as possible as the October 31st deadline approaches. 

The upload period has been extended from October 16 to October 23, however, due to a very strict timeline for receiving the data to use for subsidy calculations, the Department is unable to offer time extensions to certify your October 1 enrollment. Therefore, changes to data will automatically refresh the EPS reports up until October 23rd, after that point in time, any changes will require a manual refresh.  Enrollment certification reports cannot be submitted until October 24th, but are still due by October 31st. 

A significant number of SAUs have not uploaded any student enrollment and program data into the new Synergy student information system.  Please upload your data right away so that we are able to help ensure the data is correct before the deadline for correcting data has passed. Special Education data that was loaded prior to 1PM, Friday, October 6, 2017 will need to be re-uploaded due to technical issues with this data.  We apologize for this extra work.

PRIORITY NOTICE: Maine DOE’s path forward with respect to Chapter 134 (Regulations for Awarding a High School Diploma)

After careful review of all oral and written comments received by the Maine DOE regarding proposed rule Chapter 134, Regulations for Awarding a High School Diploma, the Maine DOE has made the decision to withdraw the current proposed rule and restart the rulemaking process after a brief pause for conceptual conversations. The conceptual conversations will provide an opportunity to explore areas needing greater clarity in the current proposed rule Chapter 134. The Maine DOE remains committed to the proficiency-based diploma law (20-A MRS 4722-A) and remains committed to drafting a proposed rule that supports the implementation of a diploma based on evidence of proficiency.

The Department intends to start a new rulemaking process for proposed rule Chapter 134 once the following steps have been taken:

1.) During the month of October, Maine DOE’s Proficiency-based Education (PBE) Specialist will reach out to professional organizations to invite representatives from each of their stakeholder groups (superintendents, principals, curriculum leaders, special education directors, teachers, parents, and school board members) to engage in small (approximately 15 participants), role-alike, conceptual discussions regarding equitable access to a high school diploma and student readiness for entering career and college opportunities after high school. A randomly selected high school from each superintendent region will be contacted to engage in small (approximately 15 participants) conceptual conversations with students. These conceptual discussions will be facilitated by the Maine DOE PBE Specialist and guided by the following discussion prompts. (The Commissioner and other Maine DOE members may join the conversations as their schedules allow.):

a.) To what degree do you agree or disagree with this statement and why: The knowledge, required skills, and qualifications required for entrance into post-secondary opportunities in industry, trade, business, and higher education vary.

What do you see is needed to prepare students for their post-secondary next step?

b.) To what degree do you agree or disagree with this statement and why: The transcript and diploma are inseparable companion documents that together articulate a student’s readiness for the postsecondary next step she or he has chosen.

What do you see is needed to clearly articulate a student’s readiness for the postsecondary next step she or he has chosen?

To what degree do you agree or disagree with this statement and why: The high school transcript must clearly communicate the student’s proficiency across the grade span progressions (preschool-grade 2; grades 3-5; grades 6-8; grades 9-12) thus providing a clear, accurate communication of what the student has achieved and what the diploma based on proficiency represents for each student.

d.) To what degree do you agree or disagree with this statement and why: Every student needs a personal learning plan and a small team whose primary goal is to understand the student’s aspirations, strengths, challenges, contexts of his or her life. The team works collaboratively with the student and others to provide the student access to learning experiences that support her or him so that she or he may learn as close to full potential as humanly possible. The focus on the team is always on the student developing competencies that will support her or his aspirations and development of efficacy towards these aspirations as well as the student’s ability to reach the highest grade span proficiency level possible while eligible to attend our public schools.

2.) Taking into consideration the insights gained from the upcoming conceptual discussions and the September public comments, the Maine DOE staff will write a new proposed rule Chapter 134 and begin again the Maine Administrative Procedures Act (A.P.A.) routine technical rule process pursuant to 5 MRS §8052 (public notice of filing, public hearing, open public comment period).The Maine DOE is working diligently to honor the integrity and vision for the high school diploma and transcript articulated in Maine education statute 20-A MRS §4722-A as well as the routine technical rulemaking pursuant to section §4722-A subsection 7. Maine DOE believes public input is a critically important.

It is clear from the oral and written comments submitted on proposed rule Chapter 134 that there is commitment in Maine to provide opportunity for all students to learn as much as they can the entire time the students are eligible to attend our public schools. It is also clear that the diploma has great social meaning and currency in our society. Clearly evident in the comments is that equity sits at the heart of the debate regarding what constitutes sufficient evidence for proficiency. PRIORITY NOTICE: Arts education participation and access data needed

The Maine Department of Education is committed to supporting access to, and participation in the arts as part of Maine students’ well-rounded education. In order to provide a view of trends, challenges, and successes in PreK-12th grade arts education, the department is asking school districts to submit student participation and access data for the 2016-2017 school year. School level data that includes courses and enrollment numbers forms the basis of the data collection. Student names, personal information, and unique student identities are not included in this collection.

The Maine DOE will be reviewing and analyzing this arts education data, conduct in-depth analysis of the information, and align instructional practices and resources to support engaging arts experiences for learners. Additionally, and perhaps most importantly, collecting this data will make Maine eligible to apply for arts education grants, resources, and additional supports.

PRIORITY NOTICE: Regional Service Center application and guidance now available

The Maine Department of Education is pleased to announce that guidance documents, applications and forms for Regional Service Centers are now available on the EMBRACE Regionalization Information Center located on the Maine Department of Education Website.

In a two part application process for Regional Service Centers, pursuant to 20-A M.R.S. Chapter 123: School Management and Leadership Centers (SMLC), part one of the application process is due on November 30, 2017. Facilitators are now available, along with an allocation of funds to hire them and cover some of the legal fees that may incur during preliminary work.

In a recent Maine DOE news article, educational stakeholders were notified that these resources were forthcoming as the Department continues to support Maine schools during the process of planning and developing regionalization project proposals under the EMBRACE initiative.

In addition to the formation of Regional Service Centers, the Fund for the Efficient Delivery of Educational Services (FEDES) Request for Proposal (RFP # 201708145) is an additional ongoing opportunity and can also serve as a resource to help in the formation of a Regional Service Center.

PRIORITY NOTICE: New certification system set to open for pilot schools and admins on 10/30

The Maine DOE’s new online certification system, Maine Certification Information System (MCIS), is scheduled for a soft release to staff and educators at pilot schools, and will be available to administrators, and local support system chair people statewide on Monday, October 30th. MCIS is targeted to be available to all educators and the general public by mid-November.

MCIS will completely replace the Maine DOE’s current paper certification application system. Highlights include a simple account creation process, electronic notifications about actionable items for both educators and administrators, and the ability to pay fees online.

The certification office will be closed to educators from 10/16/2017 – 10/27/2017. The office will re-open on Monday, October 30th with MCIS fully operational for all staff at pilot schools, and to administrators, and local support system chair people statewide.

As a reminder, once MCIS is in place, educators and administrators will need to create an account in order to use the system. The Maine DOE’s Certification team will be sending out individual notices to the email addresses that are on file in the NEO staff system to initiate this process. Additional training and guidance will be forthcoming.

PRIORITY NOTICE: Maine DOE Seeks Comments on Proposed Rule Chapter 134 (regulations for awarding a high school diploma)

The Maine DOE welcomes comments on proposed regulation, Chapter 134 pursuant to 20-A MRS §4722-A (Regulations for Awarding a High School Diploma). A public hearing will be held on August 14th in room 500 at the Cross State Office Building from 9-11 am. PRIORITY NOTICE: Guidance on usage of additional state funds from 2017-2018 budget

The Department has received several requests from school administrative units for guidance regarding the interpretation of PL 2017 Chapter 284, Section JJJJJJJ. The Department offers this guidance with the caveats that 1) Differing legal interpretations may be put forth and in those instances, we would recommend consulting your school unit’s legal counsel and 2) this guidance applies to the fiscal year 2017-2018 only; no analysis has yet begun regarding the application of this section of statute to fiscal year 2018-2019.

The Department offers guidance on the following scenarios for fiscal year 2017-2018:

Scenario 1: The school administrative unit has passed a budget through all applicable stages and the budget did not include a warrant article to provide the school board with authority to use any additional state funds received.  Under this scenario, Section JJJJJJJ-4 would apply and provide 50% of the increase in subsidy to reduce the school administrative unit’s required local contribution.  For combined school administrative units (RSU, SAD or CSD), the Department’s suggested distribution of the 50% subsidy increase, based on the statutory language, is posted at the link below.  For combined school units with a Private & Special Law that amends the required local share calculation under 20-A § 15688, the Department suggests utilizing the required local contribution percentages as calculated under that Private & Special Law.

Scenario 2: The school administrative unit has passed a budget through all applicable stages and the budget did include a warrant article providing the school board with the authority to use any additional state funds received.  Under this scenario, Section JJJJJJJ-5 applies and the school administrative unit may utilize the increase in subsidy as permitted under the approved article.

Scenario 3: The school administrative unit has not passed a budget.  This school administrative unit would present budget calculations which reflect the required local share and state subsidy amounts as displayed on the ED 279 dated July 12, 2017.  Section JJJJJJJ-5 would not apply as tax relief is provided via the reduction of the required mill expectation in the enacted ED 279.

PRIORITY NOTICE: Infinite Campus data entry to close at 12pm 7/13

As a reminder, as part of the planned closure of the Infinite Campus State Edition and transition to the new Synergy System, it is necessary for the Maine Department of Education (DOE) to end the 2016-2017 school year and remove access to update student data and enrollments as of 12:00pm on Thursday July 13, 2017.

In order to prepare for data migration from Infinite Campus State Edition (ICSE) to the new Synergy system and to prepare data for the new student reports in NEO, after 12:00pm on Thursday, July 13, 2017, Infinite Campus State Edition will no longer accept uploads for the 2016-2017 school year.

Users accessing ICSE will still be able to view student and enrollment data, and will be able to upload student personal data in order to get new statestudentids for students new to the Maine school system. For those new to uploading student personal data and getting statestudentids back from ICSE, the Helpdesk will be posting instructions for statestudentids to the following website:  http://www.maine.gov/doe/data/helpdesk.html

Maine DOE training for NEO and Synergy will be available during the weeks of July 24 and July 31. It is expected that new statestudentids will be generated from Synergy starting with the week of July 24, and users will receive instruction on those procedures at the trainings.

PRIORITY NOTICE: 2017-18 Enacted ED279 subsidy printouts now available

FY 2017-2018 ED 279 subsidy printouts, based on Public Law 2017 Ch. 284 are now available on the Department’s website: http://www.maine.gov/education/data/eps/epsmenu.htm

The 279 printouts reflect statutory changes to the funding formula as enacted by this legislation. (REMINDER: there will be a scheduled outage of the NEO system, where the 279s are available, from 7/13 – 7/17.)

As a reminder, Chapter 284, Part JJJJJJJ of the enacted budget bill contains language regarding required local action on the use of any increase in State subsidy. Please review this statutory language below and consult your school unit’s legal counsel should you need additional guidance. Please note that this section applies for both fiscal years 2017-18 and 2018-19.

Public Law 2017 Ch. 284 PART JJJJJJJ

Sec. JJJJJJJ-4. 20-A MRSA §15690-A is enacted to read:

  • 15690-A. Local action on increase in state share percentage Notwithstanding section 1485, subsection 5, this section applies to school budgets adopted for fiscal years 2017-18 and 2018-19.
  1. Required reduction in local contribution. If the budget of a school administrative unit is based on assumptions that include an increase in state share, pursuant to section 15690, subsection 1, paragraph C, over the amount used in the most recent approved budget as the result of an increase in the state share of the school administrative unit’s total cost of funding public education from kindergarten to grade 12 under this chapter, the increase in state share must be used as follows.
  2. Fifty percent of the increase in state share pursuant to section 15690, subsection 1, paragraph C that is attributable to the increase in the state share over the state share amount used in the most recent approved budget must be used to lower the school administrative unit’s local contribution to the total cost of funding public education from kindergarten to grade 12.
  3. The remaining 50% may be used only to increase expenditures for school purposes in cost center categories approved by the local school board, increase the allocation of finances for a reserve fund or provide an additional amount to lower the required local contribution to the total cost of education.
  4. Warrant. If the budget of the school administrative unit is based on assumptions that include an increase in state share, pursuant to section 15690, subsection 1, paragraph C, over the amount used in the most recent approved budget as the result of an increase in the state share of the school administrative unit’s total cost of funding public education from kindergarten to grade 12 under this chapter, an article in substantially the form in paragraph A must be used to authorize the use of the increase in state share for the expenditures specified in subsection 1, paragraph B after the requirements of subsection 1, paragraph A are met.
  5. “Article…….: To see what sums will be appropriated for the following purposes from the amount of the anticipated increase in state share of the school administrative unit’s total cost of funding public education from kindergarten to grade 12 over the amount used in the most recent approved budget as the result of an increase in the state share of the school administrative unit’s total cost of funding public education from kindergarten to grade 12 under this chapter:

(1) (Amount appropriated) To increase expenditures for school purposes in cost center categories approved by the board (list of amounts by category should be provided);

(2) (Amount appropriated) To increase the allocation of finances in a reserve fund for the purpose of (name of reserve fund); and

(3) (Amount appropriated) To provide a decrease in the local contribution, as defined in the Maine Revised Statutes, Title 20-A, section 15690, subsection 1, paragraph A or B, section 15690, subsection 2 or section 15690, subsection 3 for local property taxpayers for funding public education.”

  1. If as a result of a vote on the article specified in paragraph A, subparagraph (3) a school administrative unit does not raise 100% of the required local contribution pursuant to section 15690, subsection 1, the school administrative unit may petition the commissioner to waive the required proration of the state share pursuant to section 15690, subsection 1, paragraph C.
  2. If the article is approved by the voters at the budget meeting, the board of the school administrative unit may increase expenditures for the purposes approved in the article without holding a special budget meeting and budget validation referendum.

Sec. JJJJJJJ-5. Permitted use of additional funding for 2017-18 school budget. Notwithstanding the Maine Revised Statutes, Title 20-A, section 15690-A, for school budgets for the 2017-18 fiscal year only, articles approved by the voters that earmarked additional state funding contributions for increased expenditures for school purposes in fiscal year 2017-18 are permitted as approved.
