The Maine Department of Education continues to schedule virtual office hours with Department Specialist to support educators and administrators during extended remote learning. During these meetings, our specialists will be available to provide support and guidance regarding distance learning and school supports, as well as to facilitate networking and resource sharing between educators.

Thank you to the educators in Maine, nationally, and internationally who have joined these popular sessions. We are pleased to be able to offer a platform where educators can connect. We do ask that, with space limitations, priority be given to Maine educators first as these support sessions are intended for them.

PRIORITY NOTICE: Urging States to Continue Educating Students with Disabilities, Secretary DeVos Publishes New Resource on Accessibility and Distance Learning Options

New Fact Sheet Provides Additional Information on How Distance Learning Can be Used to Meet Students’ Needs During COVID-19 National Emergency

WASHINGTON — U.S. Secretary of Education Betsy DeVos announced today the Department has released new information clarifying that federal law should not be used to prevent schools from offering distance learning opportunities to all students, including students with disabilities. This new resource from the Office for Civil Rights (OCR) and the Office of Special Education and Rehabilitative Services (OSERS) explains that as a school district takes necessary steps to address the health, safety, and well-being of all its students and staff, educators can use distance learning opportunities to serve all students.

“It was extremely disappointing to hear that some school districts were using information from the Department of Education as an excuse not to educate kids,” said Secretary DeVos. “This is a time for creativity and an opportunity to pursue as much flexibility as possible so that learning continues. It is a time for all of us to pull together to do what’s right for our nation’s students.”

“Nothing issued by this Department should in any way prevent any school from offering educational programs through distance instruction,” she continued. “We need schools to educate all students out of principle, rather than educate no students out of fear. These are challenging times, but we expect schools to rise to the occasion, and the Department stands ready to assist you in your efforts.”

As the fact sheet states, schools “… should not opt to close or decline to provide distance instruction, at the expense of students, to address matters pertaining to services for students with disabilities. Rather, school systems must make local decisions that take into consideration the health, safety, and well-being of all their students and staff. To be clear: ensuring compliance with the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act (Section 504), and Title II of the Americans with Disabilities Act should not prevent any school from offering educational programs through distance instruction.”

To help schools provide distance learning in compliance with federal law, this fact sheet explains:

  • The Department recognizes that exceptional circumstances may affect how special education and related services and supports are provided to students with disabilities, and the Department will offer flexibility.
  • School districts must provide a free and appropriate public education (FAPE) to students with disabilities, and the provision of FAPE may include, as appropriate, special education and related services that can be provided via computer, internet, or phone.
  • Although online learning must be accessible to students with disabilities, federal law does not mandate the specific methodologies by which distance education must be provided.
  • In instances where technology is not accessible or where educational materials are not available in an accessible format, educators may still meet their legal obligations by providing equally effective alternate access to the curriculum or services provided to other students.

The Department will continue to work with state and local leaders to identify any additional areas where it can provide resources to support educators in their important work, and both OCR and OSERS are available to provide technical assistance during these uncertain times. The Department continues to update www.ed.gov/coronavirus with information for students, parents, educators, and local leaders about how to prevent the spread of COVID-19.

Guidance for Governor’s Executive Order Regarding Employees in Maine’s Public Schools

Where can I read the Executive Order?  The Executive Order is here.

To whom does this Executive Order apply? School administrative units (SAUs) including charter schools, CTE programs, Education in the Unorganized Territory (EUT), magnet schools, and Child Developmental Services (CDS).

Are school employees expected to work? Yes. This order is based on our collective expectation that both salaried and hourly employees are available and continuing to work and to provide urgently needed services for schools and the students they serve.

What are the implications for staff members paid by federal funds?  Please see the guidance we posted on March 18, 2020.  It can be found here.

Does the work need to be performed onsite in order to be paid? No.  Administrators may work with staff to determine some tasks that can be done remotely (putting packets together for kids, helping teachers in what they are doing, outreach, etc.). This may vary in each setting, depending on needs and resources. Work onsite should follow updated guidance for hygiene. Check DOE website.

What if an otherwise healthy staff member has been asked to self-quarantine or is in a shared living situation with someone who has been asked to self-quarantine or is sick?  They could be given tasks to be completed at home when possible and appropriate, and would continue to be paid.

What if a staff member is able and available to work, but there is no work (or limited work) for them to do? Staff members should remain on call and ready to work as opportunities and needs arise. Work offered should be something the staff member is able to perform, and staff and supervisors should have a conversation about any limitations and any support that might be needed. This is likely to be a long-term situation, and schools are likely to require different tasks to be completed at different times. These staff members should continue to receive pay, based on most recent schedule prior to the COVID-19 related emergency and individual contracts.

Where is this money coming from?  State, federal, and local resources have been appropriated and allocated to cover staffing costs for the full 2019-2020 school year.

Maine Schools Providing Meals to Students During Extended Remote Learning; Interactive Map Now Available

Through a waiver from the United States Department of Agriculture (USDA), the Maine Department of Education is able to extend the USDA’s Summer Food Service Program (SFSP) allowing school districts and community partners to provide meals to students during extended remote learning due to the coronavirus (COVID-19) pandemic.

Through the SFSP, 160 district and community partners are preparing and providing meals and food for children. School districts and communities statewide are implementing many different methods to ensure every child (ages 0 – 18) in need of food is nourished during the current suspension of classroom-based instruction. These include approved locations for meal pick-up, utilizing bus routes to deliver meals, and providing baskets of food to families.

“Maine schools are going above and beyond to make sure that their students have access to food while schools are utilizing remote learning,” said Maine Education Commissioner Pender Makin. “District and school leaders, teachers, and staff have collaboratively worked to meet the needs of students during this difficult and uncertain time, and we are so impressed with how quickly and efficiently it has all come together.”

The Department’s child nutrition team is processing SFSP applications on an ongoing basis. All school districts that are approved or in progress are serving meals. Many school districts that are ineligible (do not meet the 50% or more students receiving free or reduced lunch threshold) to participate in a SFSP have successfully partnered with regional school districts and community organizations to serve food to children. Districts interested in applying for the SFSP can do so by contacting the Maine DOE’s Child Nutrition Team.

“It doesn’t stop there. Many, if not most of our schools are distributing continued learning materials, educational packets, and other learning opportunities that keep students engaged while they are at home,” added Makin.

The Maine DOE has been scheduling and hosting daily content and topic specific virtual meetings with educators all week to provide support and guidance regarding distance learning and school supports, and to help facilitate networking and resource sharing between educators. Sessions are updated regularly on this webpage.

2020 MLTI Student Conference Cancelled

Due to the rapidly evolving novel coronavirus (COVID-19) pandemic in the State of Maine and across the U.S., the Maine Department of Education has decided to cancel the 2020 MLTI Student Conference, which was scheduled for May 21, 2020.

The large conference is attended by more than 1000 students and educators.  Based on evaluation of evolving circumstances, and in coordination with the Commissioner’s office, it is clear that it is in the best interest of all to make the cancellation decision now.

The Department’s decision was made in consideration of the health and well-being of attendees and an understanding of the challenges district staff and students will encounter upon their return to school after a significant disruption in their lives and school year.

PRIORITY NOTICE: Proposed Rulemaking for Rule Chapter 112

Chapter 112 contains procedures guiding the operations of the Professional Standards Board in its role under Title 20-A, Chapter 502-B to make recommendations to the State Board of Education and advise the Department of Education on certification issues. The rule was filed with the Secretary of State’s Office on March 13, 2020.

The rulemaking notice will be posted in the Secretary of State Newspaper ad on March 25, 2020. The comment period ends April 24, 2020 at 5:00 PM.
