Notice of Proposed Rule Change: Chapter 4-A, Procedural Rule, Equal Educational Opportunity

The Maine Department of Education and the Maine Human Rights Commission are proposing amendments to Regulation Chapter 4-A, Procedural Rule, Equal Educational Opportunity, which is a joint rule of the Maine Department of Education and the Maine Human Rights Commission.

Chapter 4-A governs the procedure to be followed in processing claims of unlawful educational discrimination filed with the Commission.

The proposed changes to Chapter 4-A are made jointly with the Maine Human Rights Commission, pursuant to 5 M.R.S.A. § 4603.  The proposed amendment to Chapter 4-A changes the term “Compliance Officer” to “Compliance Manager,” which is necessitated by a staffing change at the Maine Human Rights Commission; provides for the adoption of a third-party neutral mediation program; and adds “public charter schools” to the definition of “public school.”
